The American Federation of State, County and Municipal Employees made the charge after the administration filed a response to the Illinois Labor Relations Board on how it would make good on step increases going back to The administration said that no money was appropriated to pay the raises and that the state should only be liable for about six months of step increases. Step increases are automatic raises given to workers in the first seven to 10 years of their careers.
AFSCME took the issue to court and won a ruling that the administration should not have stopped the raises while a new contract was being negotiated. The courts sent the issue back to the ILRB to resolve. Initially, the administration wanted the ILRB to hold additional hearings on the issue, but the labor board refused. In its most recent ruling, the ILRB gave the state 20 days to explain how it was complying with the court order to pay the increases.
Although labor law requires the status quo be maintained while a new contract is negotiated, the administration said that requirement ends when an impasse is reached. Consequently, the administration said it only owes step raises until Jan. AFSCME said there are no grounds in the court ruling that limits the step increases to just the six-month period. The administration noted the case is likely to end up in the Supreme Court.
